To report suspected abuse, neglect or exploitation of older persons living in a long term care facility contact your local Long Term Care Sub-State Ombudsman, listed in the Directory of Agencies and Organizations Serving Seniors; or the Senior HelpLine.

To file a complaint against a long term care facility, call the Illinois Department of Public Health, which operates a Central Complaint Registry to record and investigate complaints regarding hospitals, nursing facilities and home health agencies and the care or lack of care of the patients. The Elder Abuse and Neglect Program, under the authority of the Elder Abuse and Neglect Act (320 ILCS 20/1 et seq.), responds to reports of alleged abuse, neglect or financial exploitation of persons 60 years of age and older. The program provides investigation, intervention and follow-up services to victims. Reports increase each year, as the older population grows and awareness of elder abuse increases. The program stresses the mentally competent older adult’s right to make their own decisions.

Equip for Equality is a private not-for-profit legal advocacy organization designated by the Governor to operate the federally mandated protection and advocacy system (P&A) to safeguard the rights of people with physical and mental disabilities, including developmental disabilities and mental illnesses.

All individuals with a disability in Illinois (as defined by the ADA) are eligible for services, including children, senior citizens, and individuals in state-operated facilities, nursing homes, and community-based programs.

The Office of State Guardian (OSG) is the largest public guardianship agency of its kind in the United States, serving nearly 6,500 adult disabled wards. With cases in virtually every Illinois county, the Office of State Guardian handles the personal, financial, and legal affairs of developmentally disabled, mentally ill and elderly persons with disablilities. DHS funds 340 community-based agencies that serve people with developmental disabilities. State-funded services are delivered in the least restrictive setting appropriate for the individual. All services and supports are aimed at helping people stay in their own communities in their own homes, family homes or small-group settings. Protecting the Rights of Older Persons Who Live in Long Term Care Facilities

Mandated by the Federal Older Americans Act and the Illinois Act on Aging, the Long Term Care Ombudsman Program protects and promotes the rights and quality of life for people who reside in long term care facilities (nursing homes). This is done through regional ombudsmen who have a hands–on working relationship with the residents and staff of the facilities within their program areas.


Pharmaceutical Assistance Program - CB/PA
Illinois Department of Revenue - Circuit Breaker Program

The program was designed to give low-income senior and disabled residents access to essential medication. Each year, a participant purchases Pharmaceutical Assistance coverage at nominal cost and receives approved prescription medication through participating pharmacies. Each participant is issued a Pharmaceutical Assistance card, which validates his or her participation in the program and shows the effective dates of coverage.


Pharmaceutical Assistance - SeniorCare
On June 1, 2002, Illinois inaugurated SeniorCare, the first-of-its-kind Section 1115 Medicaid waiver providing a prescription drug benefit to low-income seniors. SeniorCare covers seniors age 65 and older up to 200% of the federal poverty level (FPL). The full Medicaid formulary is covered by SeniorCare, meaning almost all prescription drugs are available, as well as many over-the-counter medications.

The Circuit Breaker Pharmaceutical Assistance Program ( CB/PA - Listed Above ), run by the Department of Revenue, continues to serve seniors with incomes over 200% FPL up to approximately 250% FPL, as well as individuals with disabilities up to 250% FPL.

SeniorCare began June 1, 2002, by amending an existing contract held by Revenue with a pharmacy benefits manager (PBM). Federal and State procurement laws require that, if the State continues to utilize a PBM for SeniorCare, a new competitively procured PBM contractor must be in place by July 1, 2003.

The demonstration waiver period runs through State FY 2007. During this time period,the Department is required to monitor SeniorCare spending as well as overall spending on aged Medicaid individuals to ensure that budget neutrality is achieved.

You can enroll in SeniorCare if:

  • you are 65 years of age or older,
  • you live in Illinois, AND
  • you are single and your income is no more than $17,720 a year, OR
  • you are married and you and your spouse have income of no more than $23,880 a year.

The Medicaid program is under the umbrella of the Department of Publice Aid, but the Department of Human Services serves as the intake agency - beats me

Medicaid in Illinois is called the "Medical Assistance Program". Medicaid pays for nursing home services. However, it does not pay for nursing home care for everyone. If you want Medicaid to pay for your nursing home care, you must follow procedures outlined on IDPA's web site.

To apply for Medicaid: go to your local Department of Human Services (DHS) office - You can find the nearest office by using the DHS Office Locator and selecting your county. A caseworker will ask questions and enter your answers into a computer. When you're done, the computer printout with your answers and signature is your application.

If you are physically unable to go to your local DHS office, a caseworker can call you on the telephone to interview you and help you apply. If you are a patient in a hospital, someone on the hospital staff will help you apply.

If your application is approved, your eligibility for Medicaid usually begins with the month you apply. You will receive a medical card that you can use for your medical expenses. However, you may be eligible for Medicaid for up to three months before the month you apply. If you have medical expenses during any of the three months before the month you apply, be sure to tell your caseworker so DHS can decide whether Medicaid will pay for those bills. If possible, you should not pay your medical bills until you learn whether you are eligible for Medicaid to pay them. It may be necessary for you to pay part of your income to the nursing home for your care.

When using health care facilities in Illinois, patients and their families can be assured quality of care standards have been established to ensure facilities provide health care services in a clean and safe environment that meets their physical, mental and psychological needs.

Depending on the health care provider, the Office of Health Care Regulation may license, inspect or certify those that must comply with state and federal regulations. The office also operates a 24-hour a day hotline ( 1-800-252-4343 ) that people can call to register complaints against health care facilities.

TLC in LTC of Illinois
TLC in LTC has been established as the beginning of a grass roots consumer effort. The effort is a coalition of family members with loved ones in long-term care facilities who recognize the critical need for a statewide advocacy group to represent nursing home residents in Illinois.

Veterans Care - Illinois
The Veterans Care Program is a new program designed to provide comprehensive, affordable healthcare to Illinois' uninsured veterans.

Who is eligible?
We set the eligibility requirements for the pilot program to include those veterans who have the least access to reliable healthcare. To be eligible, veterans must meet all of the following requirements:

  • Ages of 19 through 64
  • Have had no health insurance for at least six months. However, you may still be eligible if your only insurance coverage in the last six months:
  •  
  •   - Ended due to the loss of your employment or your spouse's employment
  •   - Ended due to the loss of FamilyCare or other state medical assistance
  •   - Ended due to the life-time benefit limit in your coverage
  •   - Is through a spouse's plan that you are unable to access
  •   - Is purchased through COBRA, or
  •   - Is through post active-duty TriCare coverage
  •  
  • Not eligible for VA healthcare
  • Not eligible for other state healthcare programs such as Family Care
  • Not been dishonorably discharged
  • Have served 180 consecutive days after training
  • Veterans with incomes in the approved income range (varies by county and household size)

Veterans' Homes - Illinois
Illinois Department of Veterans' Affairs site provides general information about eligibility, costs, and contact information for Illinois' four Veterans' Nursing Homes located in Anna, LaSalle, Manteno, Quincy, Illinois.

ELIGIBILITY
Specific eligibility for admission to one of the Veterans Homes is determined by Illinois law and Department rules.

Quality nursing and health care services are provided for Illinois veterans with military service of one (1) day or more during WWI, WWII, the Korean, Vietnam, or Persian Gulf conflicts, or during any period of time now, or in the future recognized by the U.S. Department of Veterans Affairs as a period of war.

Veterans must have either entered service from Illinois, or had been a resident of Illinois for one year preceding application, for admittance into a Veterans Home. Peacetime veterans with one year of HONORABLE military service may also be eligible for admission at Quincy or Anna. OTHER QUALIFYING CONDITIONS, AS REQUIRED, MUST BE MET. A spouse, or surviving spouse, may also qualify for admittance to the Quincy Veterans Home.
